Terms of Service
These terms of service ("Terms") govern your use of RideDiag, published by Everytech, a company established in Denmark (CVR 46324072, Copenhagen, Denmark, "Everytech", "we", "us", "our"), including the RideDiag apps (currently RideDiag for Moto Guzzi and RideDiag for BMW Motorrad, together the "Apps") and the ridediag.com website (together with the Apps, the "Service"). By downloading, installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are and what RideDiag is
RideDiag is an independent, third-party motorcycle diagnostic tool. It is not affiliated with, endorsed by, or sponsored by Piaggio & C. S.p.A. (which owns the Moto Guzzi trademark) or BMW AG / BMW Motorrad. Any reference to a motorcycle brand, model or dashboard is solely to describe compatibility (nominative use) and does not imply any relationship with, or approval by, the trademark owner. RideDiag is never described as "official", a "dealer tool", or as carrying OEM approval, because it is none of those things.
2. Licence to use the Service
Subject to these Terms, Everytech grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the Apps on devices you own or control, for your own diagnostic use on motorcycles you own or are authorised to work on. You may not reverse-engineer, resell, sublicense, rent, or use the Service to build a competing product, except to the extent such a restriction is not permitted by applicable law.
3. Credits and activation codes
- Reading ECU identification and fault codes is free and does not require a credit.
- Protected functions — including clearing faults, resetting a service indicator, and odometer-related writes on supported dashboards — consume one or more credits.
- Credits are obtained by redeeming an activation code. During the Danish launch phase, activation codes may be distributed free of charge at meetups; Everytech may later sell activation codes, at prices and in bundles it publishes from time to time.
- Activating a code stores certain information on Everytech's servers, described in the Privacy Policy, to operate your credit ledger and to prevent abuse of the activation system.
- Credits are non-refundable, except to the extent EU or Danish consumer protection law requires a refund (see section 6, Consumer rights and withdrawal, for the specific rule that applies to digital content).
- Everytech may suspend or revoke a device's remaining credits if it reasonably believes the activation system is being abused (for example, through fraud or attempts to bypass the catalog-verification safeguards described in section 4).
4. Acceptable use
You agree to use the Service only for lawful purposes. Without limitation, you agree that you will:
- Only perform write operations (clearing faults, resetting a service indicator, or an odometer-related write) on a motorcycle you own or are authorised to work on;
- Keep the ignition on and battery voltage at 12.0 V or above for the duration of any write operation, as the app instructs;
- Not attempt to bypass, disable, or circumvent the catalog-verification safeguards that cause the app to refuse unverified write sequences by default;
- Not use RideDiag, including its odometer-related write function, to commit odometer fraud or otherwise misrepresent a motorcycle's true mileage, or to conceal, alter or obscure the service or repair history of a motorcycle you do not own or are not authorised to modify.
5. Disclaimer
RideDiag is a diagnostic aid and is not a substitute for a qualified workshop or dealer. The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law. Everytech does not warrant that the Service is error-free, that fault descriptions or live data are complete or accurate for every motorcycle, or that write operations will always succeed.
6. Limitation of liability
To the maximum extent permitted by applicable law, Everytech is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or in connection with your use of the Service. Everytech provides no warranty for, and accepts no liability for, damage to your motorcycle, its ECU, or its dashboard caused by misuse of the Service, use of an unsupported adapter, a dropped connection during a write operation, low battery voltage, or your failure to follow the safety instructions in the app. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
7. Consumer rights and 14-day withdrawal
If you are a consumer in the EU/EEA, you generally have a 14-day right to withdraw from a purchase of digital content without giving a reason.
However, where activation codes or credits constitute digital content not supplied on a tangible medium, this withdrawal right ends once performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal. In practice: once you redeem an activation code or consume a credit against a protected function, you acknowledge that the digital content has begun to be supplied, and you lose the right to withdraw from that purchase. Unredeemed, unused activation codes remain eligible for withdrawal within 14 days of purchase, subject to applicable law.
This section does not affect any other mandatory consumer rights you have under Danish or EU law, including statutory remedies for digital content that is not as described or is defective.
8. Intellectual property and third-party marks
Everytech owns or licenses all rights in the Service, excluding third-party trademarks. Moto Guzzi is a trademark of Piaggio & C. S.p.A. BMW and BMW Motorrad are trademarks of BMW AG. These marks are used only to describe compatibility (nominative use) and their use does not imply sponsorship or endorsement by, or affiliation with, their respective owners.
9. Suspension and termination
You may stop using the Service at any time by uninstalling the Apps. Everytech may suspend or terminate your access to protected functions if you breach section 4 (Acceptable use), without prejudice to any statutory remedies available to you.
10. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Service or to applicable law. We will update the effective date above when we do, and will make reasonable efforts to notify you of material changes through the app or this website. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
11. Governing law and venue
These Terms are governed by Danish law. Any dispute arising out of or in connection with these Terms or the Service is subject to the exclusive venue of the courts of Denmark, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence, including the right to bring proceedings before the courts of that country where applicable law so provides.
